The Website is owned and managed by Coloriamoci S.r.l., represented by its legal representative, with registered office at viale Gramsci n.18, 76123 Andria (BT), Italy, Tax Code and VAT No. 07610550720 (hereinafter, “Coloriamoci”).

Before using the Website, we invite you to carefully read these general terms and conditions of use (hereinafter, the “General Conditions”) which, integrated by any note or legal notice published on the Website or referred to via links, including information relating to the Privacy Policy, govern access to and use of the Website in all its sections and parts, including registration, the creation of a personal Profile, and the purchase of Products. By using the Website, the User expresses, through conclusive conduct, their full acceptance of the General Conditions; therefore, if you do not accept these general terms of use of the Website in whole or in part, we must invite you not to use the Website in any of its sections or parts. 

2. CONDITIONS OF USE AND WEBSITE CONTENT

2.1 Access to and use of the Website, including viewing pages, registering on the Website and/or for the Newsletter, creating a personal Profile, purchasing Products, sending communications to Coloriamoci, and any other activity undertaken on or through the Website, may be undertaken by the User exclusively for personal purposes, not related to any commercial, entrepreneurial, or professional activity. 

Before proceeding with registration and the creation of a personal Profile, the User is invited to carefully read, in addition to the General Conditions, the Coloriamoci Privacy Policy. By registering on the Website, the User expresses, through conclusive conduct, their full acceptance of the Privacy Policy; therefore, should you not accept the Privacy Policy in whole or in part, we must invite you not to proceed with your registration on the Website.

The use of content and services for which registration on the Website is not required implies acceptance of the General Conditions and the consequent obligation of the User to comply with the provisions therein. Conversely, the use of services for which registration is required implies acceptance of both the General Conditions and the Special Conditions provided in the appropriate section for the Registered User. 

In the event that the User uses the Website on behalf of third parties, by accepting the General or Special Conditions, they declare and warrant that they have the power to represent, obligate, and bind the Third Party, releasing Coloriamoci from any and all liability towards the Third Party.

Coloriamoci does not control or perform any monitoring activities on such sites or their content, for which it cannot be held responsible in any way. 2.3 Coloriamoci reserves the right to update and modify, in whole or in part and at any time, both the General Conditions and the Special Conditions, as well as any contractual integrations referred to by them, including the Privacy Policy disclosure. 

The User is therefore invited to review them periodically, as the contents, as modified, will be effective from the moment of their publication on the Website and will be deemed known by the User from the first access to the Website following publication.

In the event that you do not accept the modifications made to the General and/or Special Conditions in whole or in part, we must invite you not to further use the Website and, if already registered, to proceed with the deletion of your personal Profile.

2.4 The contents of the Website are intended for Users who are natural persons, qualified as “Consumers” pursuant to Art. 3, par. 1, letter a) of Legislative Decree 206/2005, of legal age, resident or domiciled within the territory of the European Union. 

3. USER REGISTRATION ON THE WEBSITE

3.2 The User undertakes and declares to provide truthful and updated information during registration, releasing Coloriamoci from any and all liability in case of false statements. It is the User's burden and responsibility to ensure the timely updating of the information provided. 

The User is responsible for maintaining the confidentiality of their access credentials to the personal Profile and is responsible for any use of the Website by anyone who accesses it using their credentials. The User undertakes to promptly inform Coloriamoci in case of suspected breach of their personal Profile or use of their profile by unauthorized third parties.

3.3 The User is solely responsible for the storage, protection, and confidentiality of the access credentials to the personal Profile and is solely responsible for all activities carried out on the Website, releasing Coloriamoci from any and all liability. The User may, at any time, proceed with the deletion of their personal Profile by following the instructions in the dedicated section. 

3.4 Coloriamoci reserves the right to suspend or delete the User's personal Profile in the event of non-compliance by the User with the General and/or Special Conditions.

4. SUSPENSION OF SERVICES

Coloriamoci has the right to temporarily or permanently suspend access to the Website for any reason or cause; in such case, without prejudice to the execution of ongoing contracts, nothing shall be owed by Coloriamoci to the User for any reason.

In the event of temporary suspension of access to the Website for improvement, repair, maintenance, and restyling interventions, the operation of the Website will resume and continue, at the end of the suspension, according to these General Conditions. 

5. PRIVACY POLICY 

Coloriamoci invites the User who accesses and uses the Website, in any section or part and even without proceeding to the purchase of Products, to carefully read the Privacy Policy Disclosure to understand how Coloriamoci, through the Website, collects and uses the User's personal data and for what purposes. 

6. INTELLECTUAL PROPERTY RIGHTS

All contents published and present on the Website, in any format, including pages, Website design, layout, graphics, colors, drawings, tools, fonts, diagrams, methods, processes, functions, and software related to the Website, as well as legal notices and the Privacy Policy, are protected by proprietary rights, constituting the intellectual property of the Website owner.

Furthermore, Coloriamoci cannot be held responsible in any way for any damage caused by the inability to access the services offered on or through the Website, as well as for any damage caused by viruses, malware, corrupted files, errors, omissions, service interruptions, deletion of content, problems related to the network, providers, devices used by the User, unauthorized access, data alteration by third parties, or erroneous operations by the User. 

8. AUTONOMY OF THE PARTIES

Coloriamoci and the User, including the Registered User, are mutually autonomous and independent subjects. The use of services offered by Coloriamoci on or through the Website does not result in the emergence of any relationship other than the enjoyment of said services. 

9. FINAL PROVISIONS 

Should one or more of the provisions of the General Conditions be declared, in whole or in part, invalid or ineffective, it shall be considered severable from the others and shall not affect the validity and effectiveness of the other General Conditions, as well as any note, legal notice, contractual or even merely informative content published in the various sections and parts of the Website, or referred to via links, including information relating to the Privacy Policy. 

Any tolerance by Coloriamoci of conduct by the User in violation of the General Conditions does not constitute a waiver of the rights deriving from the violated provisions nor of any right or power arising from Law or contract.

10. APPLICABLE LAW AND DISPUTE RESOLUTION 

General Conditions and Special Conditions, as well as every content of the Website, are governed by Italian Law. In the event of a dispute, we invite the User to contact Coloriamoci at the contact details indicated on the Website in order to resolve the issue amicably. In the event an amicable solution is impossible, Coloriamoci hereby expresses its adherence to the “Risolvionline” mediation service, provided by the Arbitral Chamber of Milan, and better described on the website “www.risolvionline.com” to which reference is made.
